This Privacy Policy applies to https://www.tawk.to and reflects our commitments under privacy and data protection laws of Switzerland, the United Kingdom, the European Union and the European Economic Area, including the EU-U.S. Data Privacy Framework, the UK Extension, and the Swiss-U.S. DPF. It does not govern personal data processed in the context of employment.

Website Visitors

We are located in the United States and we do all processing in the United States. We rely on the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, the Swiss-U.S. DPF, contractual protections, or other approved mechanisms for transfers.

tawk.to has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. DPF Principles, the UK Extension to the EU-U.S. DPF Principles, and the Swiss-U.S. DPF Principles. Certification details are available at https://www.dataprivacyframework.gov/s/.

Data retention period

We will retain your personal information for as long as is needed to fulfill the purposes outlined in this Policy unless a longer retention period is required or permitted by law.

Jurisdiction

The Federal Trade Commission has jurisdiction over tawk.to's compliance with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF.

Questions or complaints

tawk.to commits to resolving complaints about our collection or use of your personal information transferred to the United States pursuant to these frameworks. Contact compliance@tawk.to and we aim to respond within 45 days. Unresolved complaints may be referred to JAMS at https://www.jamsadr.com/DPF-Dispute-Resolution. This dispute resolution process via JAMS is only available for non-HR data.

Security

We maintain reasonable and appropriate security measures to protect personal information from loss, misuse, unauthorized access, disclosure, alteration, or destruction.

Access Rights

If we process your personal data on behalf of one of our customers, please contact that customer with your request. For data we process for our own purposes, you may request access to personal data we hold about you and request that we correct, amend, or delete it if it is inaccurate.

A. Opt-out for non-sensitive information

You may opt out of disclosure of non-sensitive personal information to third parties not acting as our agents, and of use for purposes materially different from the original collection. Contact compliance@tawk.to.

B. Exception for third-party agents

We are not required to offer an opt-out when personal information is disclosed to a third party acting as our agent to perform tasks on our behalf and under our instructions.

C. Opt-in for sensitive information

With respect to sensitive personal information (defined under the DPF to include data revealing medical or health conditions, racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, or the sex life of the individual), we will obtain your affirmative express consent (opt-in).

D. Marketing communications

You may unsubscribe via the unsubscribe link in our marketing emails or by contacting compliance@tawk.to. We may still send you transactional or service-related communications necessary for your use of our services.

Binding Arbitration

After exhausting complaint procedures (direct contact, independent dispute resolution, and data protection authority involvement), individuals may invoke binding arbitration as described at https://www.dataprivacyframework.gov/s/.

Protection of Certain Personal Information

tawk.to discloses information only to employees, contractors, and affiliated organizations that (1) need to know that information in order to process it on tawk.to's behalf or to provide services available at tawk.to's web services, and (2) that have agreed not to disclose it to others.

tawk.to will not rent or sell potentially personally-identifying personal information to anyone.

In accordance with the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF, tawk.to is responsible for the processing of personal information it receives and subsequently transfers to a third party acting as an agent.

Children's Personal Information

We do not knowingly collect any personal information from children under the age of 13. If you believe a child under 13 has provided us with personal information, please contact privacy@tawk.to.

Business Transfers

If tawk.to, or substantially all of its assets, were acquired, or in the unlikely event that tawk.to goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. Any acquiring party would be required to be certified under the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF, or otherwise committed to providing at least the same level of protection.

Our Role as a Data Processor

tawk.to often operates as a data processor on behalf of our clients. This means that we process personal data based on the instructions of our clients, and we do not have control over or determine the purposes and means of the processing of that data.

Client's role as data controllers

Our clients act as data controllers when using our platform. As data controllers, clients have the responsibility to determine the purposes and means of processing personal data.

Client's compliance responsibility

While tawk.to is committed to providing tools and solutions that aid our clients in their data protection efforts, the onus of ensuring legal compliance remains with our clients.

Onward transfers

tawk.to may transfer your personal information and data to certain third parties (including those described under "How We Use and Disclose Your Information").
